Tealfeed Private Limited (“we”, “our”, “us”) respects the intellectual property rights of others and expects everyone on the platform to do the same. This Policy explains how we handle claims that content published on Tealfeed, such as a storefront, service description, article, or image (“Material”), infringes someone’s copyright. It is adopted under the applicable laws of India and in accordance with the Digital Millennium Copyright Act of 1998 of the United States (“DMCA”).
In this Policy, a Member is the account holder who published the Material, and you are the copyright owner (or the owner’s authorised agent) reporting it.
How to report copyright infringement
Send your notice to contact@tealfeed.com with the subject “Copyright notice”. For your notice to be valid and actionable, it must include all of the following:
- Identification of your work: a clear description of the copyrighted work you claim is infringed, with a copy of, or link to, the original work;
- Identification of the infringing Material: the exact URL (storefront page, article, or image) and enough information for us to locate it;
- Your contact information: full name, address, telephone number, and email address;
- A good-faith statement: that you believe in good faith that the use of the Material is not authorised by the copyright owner, its agent, or the law;
- An accuracy statement: that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf;
- Your signature: physical or electronic (typing your full name suffices).
We process notices in the order received; duplicate notices about the same Material may delay processing. An incomplete notice may not be actionable, and we may ask you to complete it.
What we do on receiving a valid notice
- We remove or disable access to the Material we believe in good faith to be infringing;
- We make a good-faith effort to notify the Member who published it, with a copy of the notice and instructions for filing a counter-notice;
- We record the claim for the purposes of our repeat infringer policy;
- We confirm the action taken to you by email.
Counter-notice by the Member
A Member who believes their Material was removed by mistake or misidentification can file a counter-notice by replying to our notification email with all of the following:
- The Member’s full name, address, telephone number, and email address;
- Identification of the Material that was removed or disabled, and the location where it appeared before removal;
- A statement, under penalty of perjury, that the Member believes in good faith that the Material was removed or disabled as a result of mistake or misidentification;
- A statement that the Member consents to the jurisdiction of the courts at New Delhi, India, and, where the DMCA applies, of the United States federal district court for the district in which the Member is located (or, if outside the United States, any district in which Tealfeed may be found), and that the Member will accept service of process from the person who filed the original notice;
- A physical or electronic signature (typing the full name suffices).
When we receive a valid counter-notice, we promptly forward a copy to the person who filed the original notice. Unless that person notifies us within ten (10) business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the removed Material within ten (10) to fourteen (14) business days of receiving the counter-notice.
Reposting removed Material instead of filing a counter-notice is a violation of this Policy and may result in permanent account suspension.
Misrepresentation
Filing a false or bad-faith notice or counter-notice has real legal and financial consequences: anyone who knowingly and materially misrepresents that Material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorney’s fees, incurred by us, the Member, or the copyright owner. If you are not sure whether you are the rights holder, or whether the use qualifies as fair use or fair dealing, consult a lawyer before filing.
Repeat infringer policy
We terminate the accounts of repeat infringers in appropriate circumstances. Copyright claims can be misused to silence legitimate speech, so we evaluate repeat infringement case by case rather than mechanically. We will consider remedial action, including written warnings, storefront restrictions, and account termination, when a credible complaint identifies a pattern, or when we receive more than three (3) valid notices about different Material from the same Member within a calendar year.
Transfer of information
Notices are not private documents: your notice, including your name and contact details, is forwarded to the Member who published the reported Material, and a Member’s counter-notice is forwarded to you. We may also publish redacted copies of notices for transparency reporting. Personal information in notices is otherwise handled in accordance with our Privacy Policy.
